Ce cadre visait \u00e0 \u00e9tablir une approche coh\u00e9rente et uniforme, \u00e0 l\u2019\u00e9chelle du gouvernement, pour obtenir des renseignements d\u2019entit\u00e9s \u00e9trang\u00e8res et leur en communiquer. Une directive minist\u00e9rielle a ensuite \u00e9t\u00e9 publi\u00e9e, en 2011, \u00e0 l\u2019intention des minist\u00e8res concern\u00e9s relativement \u00e0 l\u2019\u00e9change de renseignements avec des entit\u00e9s \u00e9trang\u00e8res, suivie d\u2019une autre en 2017, intitul\u00e9e \u00ab \u00c9viter la complicit\u00e9 dans les cas de mauvais traitements par des entit\u00e9s \u00e9trang\u00e8res \u00bb.<\/p>\n\n\n\n<p>Le 13 juillet 2019, la Loi visant \u00e0 \u00e9viter la complicit\u00e9 est entr\u00e9e en vigueur. Cette loi codifie et garantit les engagements du Canada \u00e0 l\u2019\u00e9gard de la Charte canadienne des droits et libert\u00e9s, ainsi que les obligations juridiques internationales du pays pour ce qui est de pr\u00e9venir les actes de torture et autres traitements cruels et inhumains.<\/p>\n\n\n\n<p>Le 4 septembre 2019, conform\u00e9ment \u00e0 l\u2019article 3 de la Loi, le gouverneur en conseil a donn\u00e9 des instructions \u00e9crites aux administrateurs g\u00e9n\u00e9raux des 12 minist\u00e8res et organismes suivants : ASFC, ARC, SCRS, CST, MPO, MDN\/FAC, CANAFE, AMC, IRCC, SP, GRC et TC.<\/p>\n\n\n\n<p>Le gouverneur en conseil a donn\u00e9 des instructions portant principalement sur trois aspects de la gestion de l\u2019information dans les rapports entretenus avec une entit\u00e9 \u00e9trang\u00e8re : la communication de renseignements, la demande de renseignements et l\u2019utilisation de tout renseignement obtenu.<\/p>\n\n\n\n<p>En vertu de l\u2019article 7 de la Loi, tout administrateur g\u00e9n\u00e9ral \u00e0 qui des instructions ont \u00e9t\u00e9 donn\u00e9es doit, avant le 1er mars de chaque ann\u00e9e, soumettre au ministre comp\u00e9tent un rapport sur la mise en \u0153uvre de celles-ci au cours de l\u2019ann\u00e9e civile pr\u00e9c\u00e9dente.
