Les directives limitent &eacute;galement la mani&egrave;re dont les minist&egrave;res peuvent utiliser l&rsquo;information susceptible d&rsquo;avoir &eacute;t&eacute; obtenue &agrave; la suite de mauvais traitements. Globalement, le r&eacute;gime de la LECCMTIEE codifie les valeurs et les engagements du Canada au titre de la <em>Charte canadienne des droits et libert&eacute;s<\/em>, du <em>Code criminel<\/em> et du droit international en ce qui concerne la protection des droits et l&rsquo;interdiction de tout recours &agrave; la torture ou &agrave; d&rsquo;autres traitements cruels ou inhumains.&nbsp;<\/p><\/p>\n\n\n\n<p>Chaque ann\u00e9e civile, l\u2019OSSNR est tenu d\u2019examiner la mise en \u0153uvre de toutes les directives \u00e9mises dans le cadre de la LECCMTIEE. \u00c0 ce jour, de telles directives ont \u00e9t\u00e9 donn\u00e9es aux administrateurs g\u00e9n\u00e9raux de douze minist\u00e8res et organismes. L\u2019examen que l\u2019OSSNR r\u00e9alise chaque ann\u00e9e quant \u00e0 la mise en \u0153uvre de la LECCMTIEE garantit que le gouvernement du Canada demeure responsable \u00e0 l\u2019\u00e9gard de l\u2019information faisant l\u2019objet d\u2019\u00e9changes avec ses partenaires \u00e9trangers et qu\u2019il respecte les valeurs canadiennes de m\u00eame que les engagements qui en d\u00e9coulent. Bien que la LECCMTIEE exige que chacun des minist\u00e8res concern\u00e9s rende compte \u00e0 son ministre et au public de la mise en \u0153uvre de la LECCMTIEE chaque ann\u00e9e, il convient de noter que le mandat d\u2019examen horizontal de l\u2019OSSNR se d\u00e9marque dans la mesure o\u00f9 il permet de donner un aper\u00e7u unique de la coh\u00e9rence de cette mise en \u0153uvre ainsi que des d\u00e9cisions connexes prises \u00e0 l\u2019\u00e9chelle du gouvernement.&nbsp;<\/p>\n\n\n\n<p>L\u2019examen de la LECCMTIEE r\u00e9alis\u00e9 par l\u2019OSSNR pour 2022 s\u2019est concentr\u00e9 sur les modes par lesquels les minist\u00e8res ont \u00e9valu\u00e9 le risque de mauvais traitements dans le contexte de leurs \u00e9changes d\u2019information avec des entit\u00e9s \u00e9trang\u00e8res. L\u2019OSSNR s\u2019est fix\u00e9 cet objectif dans la mesure o\u00f9 la conformit\u00e9 des minist\u00e8res aux directives d\u00e9pend largement de leur capacit\u00e9 \u00e0 reconna\u00eetre les \u00e9changes d\u2019information qui sont susceptibles de pr\u00e9senter un risque important de mauvais traitements. Si les minist\u00e8res sous-\u00e9valuent le niveau de risque li\u00e9 \u00e0 un \u00e9change ou s\u2019ils sur\u00e9valuent l\u2019impact des mesures prises afin de r\u00e9duire ce risque, ils ne seront pas en mesure d\u2019enclencher les m\u00e9canismes de reddition de comptes et de transparence pr\u00e9vus par la LECCMTIEE. En outre, ces m\u00e9canismes comprennent le renvoi de certains cas \u00e0 risque \u00e9lev\u00e9 aux administrateurs g\u00e9n\u00e9raux, ainsi que la transmission de rapports \u00e0 l\u2019OSSNR.\u00a0&nbsp;<\/p>\n\n\n\n<p>L\u2019OSSNR a constat\u00e9 des incoh\u00e9rences majeures dans la fa\u00e7on dont les minist\u00e8res du gouvernement du Canada \u00e9valuaient le risque de mauvais traitements pos\u00e9 par certains pays. L\u2019OSSNR a m\u00eame relev\u00e9 des cas o\u00f9, suivant leurs \u00e9valuations respectives du risque de mauvais traitements, des minist\u00e8res avaient attribu\u00e9 diverses cotes de risque \u00ab\u202ffaible\u202f\u00bb ou \u00ab\u202fmoyen\u202f\u00bb, voire \u00ab\u202f\u00e9lev\u00e9\u202f\u00bb \u00e0 un m\u00eame pays. L\u2019OSSNR a \u00e9galement constat\u00e9 que les minist\u00e8res avaient souvent attribu\u00e9 un poids exag\u00e9r\u00e9ment \u00e9lev\u00e9 aux mesures propos\u00e9es pour l\u2019att\u00e9nuation des risques et que, dans certains cas, ces minist\u00e8res incorporaient de mani\u00e8re erron\u00e9e les mesures d\u2019att\u00e9nuation dans leurs \u00e9valuations initiales du risque de base par pays.&nbsp;&nbsp;<\/p>\n\n\n\n<p>De telles failles m\u00e9thodologiques ainsi que l\u2019absence de freins et de contrepoids dans le processus d\u2019\u00e9valuation des risques peuvent amener les minist\u00e8res \u00e0 sous\u00e9valuer syst\u00e9matiquement les risques pos\u00e9s par les \u00e9changes d\u2019information envisag\u00e9s. En d\u00e9finitive, il s\u2019av\u00e8re que lorsqu\u2019il ne se conforme pas aux dispositions essentielles des instructions donn\u00e9es au titre de la LECCMTIEE, le gouvernement du Canada risque de proc\u00e9der \u00e0 des \u00e9changes d\u2019information qui seraient contraires aux interdictions pr\u00e9vues par les directives.\u00a0&nbsp;<\/p>\n\n\n\n<p>Dans le cadre d\u2019une s\u00e9rie de recommandations devant permettre de faire face \u00e0 ce risque, l\u2019OSSNR a r\u00e9it\u00e9r\u00e9 sa recommandation de 2019 voulant que le gouvernement du Canada \u00e9labore une approche unifi\u00e9e en mati\u00e8re d\u2019\u00e9valuations des risques dans le contexte de la LECCMTIEE. Dans chaque examen r\u00e9alis\u00e9 depuis 2019 concernant la LECCMTIEE, l\u2019OSSNR a maintenu la position selon laquelle les risques li\u00e9s aux droits de la personne dans un pays donn\u00e9 devraient \u00eatre \u00e9valu\u00e9s de mani\u00e8re coh\u00e9rente dans l\u2019ensemble du gouvernement.
