de la d\u00e9cision rendue par la Cour f\u00e9d\u00e9rale le 16 juillet 2020 quant \u00e0 la l\u00e9galit\u00e9 de certaines des activit\u00e9s faisant appel \u00e0 des sources humaines de renseignement du Service canadien du renseignement de s\u00e9curit\u00e9 (SCRS) et au non-respect de son obligation de franchise envers la Cour.<\/p>\n\n\n\n<p>La Cour f\u00e9d\u00e9rale a examin\u00e9 l\u2019application par le SCRS de la doctrine juridique de l\u2019immunit\u00e9 de la Couronne aux activit\u00e9s faisant appel \u00e0 des sources humaines dans le contexte des demandes de mandat pr\u00e9sent\u00e9es par le SCRS. Jusqu\u2019au d\u00e9but de 2019, le SCRS invoquait la doctrine de l\u2019immunit\u00e9 de la Couronne pour justifier diverses mesures normalement consid\u00e9r\u00e9es comme illicites et prises pendant la collecte de renseignement par les employ\u00e9s du SCRS et par des personnes agissant sous leur direction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"1-sirc-reviews-of-csis-human-source-activities\">Examens du csars des activit\u00e9s du scrs faisant appel \u00e0 des sources humaines<\/h2>\n\n\n\n<p>Dans sa d\u00e9cision, la Cour a cit\u00e9 le r\u00f4le du Comit\u00e9 de surveillance des activit\u00e9s de renseignement de s\u00e9curit\u00e9 (CSARS), qui a attir\u00e9 l\u2019attention sur les probl\u00e8mes que posait l\u2019invocation de l\u2019immunit\u00e9 de la Couronne par le SCRS. Le CSARS, qui a \u00e9t\u00e9 cr\u00e9\u00e9 parall\u00e8lement au SCRS en 1984, a attentivement examin\u00e9 les activit\u00e9s du SCRS jusqu\u2019\u00e0 ce qu\u2019il soit remplac\u00e9 par l\u2019OSSNR, en juillet 2019. Pendant cette p\u00e9riode, le CSARS a r\u00e9guli\u00e8rement examin\u00e9 le recours \u00e0 des sources humaines par le SCRS pour obtenir des renseignements. Exemples :<\/p>\n\n\n\n<ul>\n<li class=\"translation-block\"><li>Dans l\u2019examen du 12 mai 2015 <a class=\"c-link\" href=\"http:\/\/www.sirc.gc.ca\/opbapb\/lsrlse\/2014\/2014-07-fra.html\" target=\"_blank\" rel=\"noopener noreferrer\" aria-label=\"CSIS's Relationship and Exchanges with the Department of Foreign Affairs, Trade and Development - (opens in a new tab)\">La relation et les \u00e9changes entre le SCRS et le minist\u00e8re des Affaires \u00e9trang\u00e8res, du Commerce et du D\u00e9veloppement,Note de bas de page<\/a>&nbsp;(1) le CSARS attirait l\u2019attention sur les contraintes juridiques auxquelles le SCRS faisait face en ce qui concerne ses op\u00e9rations faisant appel \u00e0 des sources humaines, en soulignant que certaines des op\u00e9rations du SCRS \u00e0 l\u2019\u00e9tranger pouvaient contrevenir au R\u00e8glement d\u2019application des r\u00e9solutions des Nations Unies sur Al-Qa\u00efda et le Taliban et \u00e0 des lois semblables. Le CSARS a par la suite demand\u00e9 au SCRS d\u2019examiner ses propres activit\u00e9s afin de s\u2019assurer de leur conformit\u00e9.<\/li><\/li>\n<\/ul>\n\n\n\n<ul>\n<li class=\"translation-block\"><li>Dans <a class=\"c-link\" href=\"http:\/\/www.sirc.gc.ca\/opbapb\/lsrlse\/2015\/2015-09-fra.html\" target=\"_blank\" rel=\"noopener noreferrer\" aria-label=\"CSIS's Investigation of Canadian Foreign Fighters - (opens in a new tab)\">Un examen de l\u2019enqu\u00eate du SCRS sur les \u00ab\u2009combattants \u00e9trangers\u2009\u00bb canadiens<\/a>du 27 mai 2016 (2), le CSARS notait les risques juridiques li\u00e9s \u00e0 certaines op\u00e9rations du SCRS et recommandait que le SCRS demande des \u00e9claircissements sur le plan juridique pour savoir si les employ\u00e9s du Service et ses sources humaines b\u00e9n\u00e9ficient d\u2019une protection, sous le r\u00e9gime de la r\u00e8gle de common law de l\u2019immunit\u00e9 de la Couronne, en ce qui concerne les infractions li\u00e9es au terrorisme aux termes du Code criminel.<\/li><\/li>\n<\/ul>\n\n\n\n<p>Le projet de loi C-59, Loi concernant des questions de s\u00e9curit\u00e9 nationale, a \u00e9t\u00e9 d\u00e9pos\u00e9 le 20 juin 2017, il a re\u00e7u la sanction royale le 21 juin 2019 et est maintenant en vigueur. Le projet de loi C-59 comprenait de nouvelles dispositions autorisant le SCRS \u00e0 r\u00e9aliser des activit\u00e9s faisant appel \u00e0 des sources humaines en b\u00e9n\u00e9ficiant d\u2019une protection juridique explicite. Ces dispositions ne s\u2019appliquent toutefois pas r\u00e9troactivement.<\/p>\n\n\n\n<p>Le CSARS a poursuivi son examen des activit\u00e9s du SCRS faisant appel \u00e0 des sources humaines apr\u00e8s la pr\u00e9sentation du projet de loi C-59. Dans son rapport annuel de 2016-2017, le CSARS a soulign\u00e9 que le SCRS continuait de mener des op\u00e9rations avec des sources humaines et que ces op\u00e9rations risquaient d\u2019enfreindre le droit canadien. Le CSARS mentionnait \u00e9galement qu\u2019il surveillerait les mesures prises par le SCRS pour att\u00e9nuer les risques juridiques li\u00e9s aux op\u00e9rations faisant appel \u00e0 des sources humaines en attendant l\u2019entr\u00e9e en vigueur du projet de loi C-59.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2-sirc%E2%80%99s-certification-of-the-csis-director%E2%80%99s-2017-2018-report\">Certification par le csars du rapport 2017-2018 du directeur du scrs<\/h2>\n\n\n\n<p>Dans la certification du rapport annuel 2017-2018 que le directeur du SCRS a pr\u00e9par\u00e9 \u00e0 l\u2019intention du ministre de la S\u00e9curit\u00e9 publique et de la Protection civile, le CSARS concluait qu\u2019\u00e0 son avis certaines des activit\u00e9s faisant appel \u00e0 des sources humaines men\u00e9es par le SCRS ne pouvaient se justifier par la doctrine de l\u2019immunit\u00e9 de la Couronne. Il pr\u00e9cisait que le SCRS avait r\u00e9alis\u00e9 des activit\u00e9s faisant appel \u00e0 des sources humaines m\u00eame s\u2019il savait que ces activit\u00e9s n\u2019\u00e9taient pas conformes \u00e0 la Loi sur le Service canadien du renseignement de s\u00e9curit\u00e9 ni \u00e0 l\u2019instruction minist\u00e9rielle qui pr\u00e9cise que la r\u00e8gle de droit doit \u00eatre observ\u00e9e. Le CSARS a \u00e9galement pr\u00e9cis\u00e9 que le directeur devait rendre compte de ces activit\u00e9s au ministre et au procureur g\u00e9n\u00e9ral du Canada en vertu de l\u2019article 20 de la Loi sur le SCRS. Le certificat du CSARS du 21 mars 2019 a \u00e9t\u00e9 remis au ministre et au directeur du SCRS.<\/p>\n\n\n\n<p class=\"translation-block\"><p>L\u2019OSSNR abordera la question du certificat du CSARS dans son premier rapport annuel, qui sera publi\u00e9 l\u2019automne prochain. Compte tenu de la d\u00e9cision r\u00e9cemment rendue par la Cour f\u00e9d\u00e9rale, l\u2019OSSNR a \u00e9galement publi\u00e9 une version caviard\u00e9e du certificat, que l\u2019on peut consulter <a class=\"c-link\" href=\"https:\/\/www.nsira-ossnr.gc.ca\/wp-content\/uploads\/2020\/11\/FR_Certificates_2018_07.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" aria-label=\"here - (opens in a new tab)\">ici<\/a>.<\/p><\/p>\n\n\n\n<p class=\"translation-block\"><p>Pour en savoir plus sur l\u2019OSSNR et son mandat, veuillez consultez <a class=\"c-link\" href=\"https:\/\/nsira-ossnr.gc.ca\/fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" aria-label=\"our website - (opens in a new tab)\">notre site Web<\/a>.<\/p><\/p>\n\n\n\n<p>Dans sa d\u00e9cision, la Cour f\u00e9d\u00e9rale souligne que le SCRS a omis de fournir de l\u2019information importante au CSARS (3). En outre, le SCRS a tard\u00e9 \u00e0 communiquer au CSARS un avis juridique essentiel sur l\u2019immunit\u00e9 de la Couronne pendant pr\u00e8s de deux ans, soit jusqu\u2019en janvier 2019, date \u00e0 laquelle le CSARS a \u00e9t\u00e9 inform\u00e9 de l\u2019affaire \u00e0 l\u2019examen par la Cour f\u00e9d\u00e9rale. Le CSARS a \u00e9galement not\u00e9 dans le certificat que des faits essentiels avaient \u00e9t\u00e9 omis dans des notes d\u2019information et des rapports traitant de ce sujet et soumis au ministre de la S\u00e9curit\u00e9 publique et de la Protection civile.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-the-way-forward\">Prochaines \u00e9tapes<\/h2>\n\n\n\n<p>Les membres de l\u2019OSSNR sont fermement convaincus que le SCRS doit absolument faire preuve de la plus grande franchise envers les personnes et les institutions charg\u00e9es d\u2019examiner et de surveiller ses activit\u00e9s pour que le cadre de reddition de compte en mati\u00e8re de s\u00e9curit\u00e9 nationale fonctionne efficacement. Ces institutions comprennent non seulement la Cour f\u00e9d\u00e9rale, mais \u00e9galement des organismes de surveillance comme l\u2019OSSNR.<\/p>\n\n\n\n<p>L\u2019examen ind\u00e9pendant du SCRS est une exigence l\u00e9gale pour l\u2019OSSNR. L\u2019OSSNR examine les activit\u00e9s du SCRS pour s\u2019assurer qu\u2019elles sont conformes aux lois et aux instructions du ministre et pour v\u00e9rifier le caract\u00e8re raisonnable et n\u00e9cessaire des activit\u00e9s du SCRS.<\/p>\n\n\n\n<p>Dans sa d\u00e9cision, la Cour f\u00e9d\u00e9rale recommande qu\u2019un examen externe exhaustif soit effectu\u00e9 afin de cerner les lacunes et d\u00e9faillances syst\u00e9miques, culturelles et relatives \u00e0 la gouvernance qui ont men\u00e9 le SCRS \u00e0 prendre des mesures ill\u00e9gales et \u00e0 ne pas respecter son obligation de franchise envers la Cour. L\u2019OSSNR a \u00e9t\u00e9 saisi d\u2019examiner ces questions par le ministre de la S\u00e9curit\u00e9 publique et de la Protection civile et le ministre de la Justice en vertu de l\u2019alin\u00e9a 8(1)(c) de la Loi sur l\u2019OSSNR.<\/p>\n\n\n\n<p>Par cons\u00e9quent, l\u2019OSSNR proc\u00e9dera imm\u00e9diatement \u00e0 un examen exhaustif dans la m\u00eame veine de ce qui est recommend\u00e9 par la Cour. Cet examen portera principalement sur le SCRS et le minist\u00e8re de la Justice. L\u2019OSSNR pourra \u00e9galement examiner d\u2019autres aspects appropri\u00e9s reli\u00e9s aux \u00e9v\u00e8nements, en conformit\u00e9 avec le mandat de notre organisation. Cet examen se d\u00e9roulera sous la direction de deux membres actuels de l\u2019OSSNR : l\u2019honorable Marie Deschamps, C.C., ancienne juge de la Cour supr\u00eame du Canada, et Craig Forcese, professeur \u00e0 la Facult\u00e9 de droit de l\u2019Universit\u00e9 d\u2019Ottawa.
