id=\"1-introduction\">Introduction<\/h2>\n\n\n\n<p>Des&nbsp;<em>Loi sur la protection des renseignements personnels&nbsp;<\/em>(LPRP) conf\u00e8re aux\nparticuliers le droit de consulter les renseignements personnels qu\u2019une institution\ngouvernementale d\u00e9tient \u00e0 leur sujet, sous r\u00e9serve de certaines exceptions\npr\u00e9cises. Elle prot\u00e8ge aussi le droit \u00e0 la vie priv\u00e9e en emp\u00eachant l\u2019acc\u00e8s non\nautoris\u00e9 aux renseignements personnels, et en donnant un pouvoir substantiel\naux personnes physiques de limiter la collecte, l\u2019utilisation, et la divulgation de\nleurs renseignements personnels.<\/p>\n\n\n\n<p>L\u2019Office de surveillance des activit\u00e9s en mati\u00e8re de s\u00e9curit\u00e9 nationale et de\nrenseignement (OSSNR) a le plaisir de pr\u00e9senter au Parlement son rapport\nannuel sur l\u2019application de la LPRP concernant l\u2019exercice commen\u00e7ant le\n1er avril 2019 et se terminant le 31 mars 2020. Le pr\u00e9sent rapport est d\u00e9pos\u00e9 en\napplication de l\u2019article 72 de la LPRP.<\/p>\n\n\n\n<p>L\u2019OSSNR est un nouvel organisme de surveillance externe ind\u00e9pendant qui\nrel\u00e8ve du Parlement. \u00c9tabli en juillet 2019, l\u2019OSSNR, a pour mandat d\u2019examiner\ntoutes les activit\u00e9s du gouvernement du Canada en mati\u00e8re de s\u00e9curit\u00e9 nationale\net de renseignement, afin de s\u2019assurer qu\u2019elles sont l\u00e9gales, raisonnables et\nn\u00e9cessaires. L\u2019OSSNR entend \u00e9galement les plaintes du public \u00e0 l\u2019endroit des\nprincipales agences et activit\u00e9s de s\u00e9curit\u00e9 nationale. L\u2019OSSNR remplace le\nComit\u00e9 de surveillance des activit\u00e9s de renseignement de s\u00e9curit\u00e9 (CSARS), qui\nexaminait les activit\u00e9s du Service canadien du renseignement de s\u00e9curit\u00e9 ainsi\nque celles li\u00e9es \u00e0 la r\u00e9vocation ou au refus des autorisations de s\u00e9curit\u00e9.\nL\u2019OSSNR entendra maintenant \u00e9galement les plaintes visant le Centre de la\ns\u00e9curit\u00e9 des t\u00e9l\u00e9communications, et les plaintes sur la s\u00e9curit\u00e9 nationale\nimpliquant la Gendarmerie royale du Canada.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2-mandate\">Structure Organisationnelle<\/h2>\n\n\n\n<p>La responsabilit\u00e9 d\u2019administrer les activit\u00e9s d\u00e9coulant de la LPRP est d\u00e9l\u00e9gu\u00e9e\nau directeur ex\u00e9cutif de l\u2019OSSNR, et subd\u00e9l\u00e9gu\u00e9e au coordonnateur de l\u2019acc\u00e8s \u00e0\nl\u2019information et de la protection des renseignements personnels (AIPRP),\nconform\u00e9ment \u00e0 l\u2019ordonnance de d\u00e9signation fournie \u00e0 l\u2019annexe A.<\/p>\n\n\n\n<p>La personne qui occupe le poste de directeur ex\u00e9cutif, en titre ou par int\u00e9rim,\npeut exercer tous les pouvoirs, devoirs et fonction pr\u00e9vus dans la LPRP. Le\ncoordonnateur de l\u2019AIPRP exerce ses fonctions en vertu d\u2019une d\u00e9l\u00e9gation\nrestreinte.<\/p>\n\n\n\n<p>Le coordonnateur travaille avec le bureau du directeur ex\u00e9cutif, les services\njuridiques et des registres, ainsi qu\u2019avec la direction g\u00e9n\u00e9rale des \u00e9valuations\npour r\u00e9pondre aux exigences du programme d\u2019AIPRP.<\/p>\n\n\n\n<p>La fonction est ex\u00e9cut\u00e9e par un employ\u00e9 form\u00e9 qui est membre de la direction\ng\u00e9n\u00e9rale des services minist\u00e9riels.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-basis-of-presentation\">Ordonnance de d\u00e9l\u00e9gation de pouvoirs<\/h2>\n\n\n\n<p>Une copie sign\u00e9e et dat\u00e9e de l\u2019ordonnance de d\u00e9l\u00e9gation, en vigueur \u00e0 la fin de\nla p\u00e9riode vis\u00e9e par le pr\u00e9sent rapport, figure \u00e0 titre d\u2019annexe A.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4-performance\">Rendement<\/h2>\n\n\n\n<p>L\u2019OSSNR a re\u00e7u quatre demandes li\u00e9es \u00e0 la LPRP. Parmi ces demandes, trois\n(75 %) ont \u00e9t\u00e9 ferm\u00e9es pendant la p\u00e9riode de r\u00e9f\u00e9rence. Les r\u00e9ponses \u00e0 deux de\nces trois demandes ont \u00e9t\u00e9 transmises en-dehors des d\u00e9lais pr\u00e9vus par la loi. Le\nvolume de demandes re\u00e7ues est demeur\u00e9 peu \u00e9lev\u00e9; une seule demande a \u00e9t\u00e9\nre\u00e7ue au cours de l\u2019exercice pr\u00e9c\u00e9dent. L\u2019une des demandes dont la r\u00e9ponse a\n\u00e9t\u00e9 transmise en-dehors des d\u00e9lais pr\u00e9vus par la loi a men\u00e9 \u00e0 une plainte, que le\nCommissariat \u00e0 la protection de la vie priv\u00e9e (CPVP) a ferm\u00e9e le 1er janvier 2020.<\/p>\n\n\n\n<p>La deuxi\u00e8me demande a \u00e9t\u00e9 re\u00e7ue le 18 mars 2020 et la r\u00e9ponse a \u00e9t\u00e9\ntransmise le 17 juin 2020, soit 45 jours apr\u00e8s la date limite pr\u00e9vue par la loi.<\/p>\n\n\n\n<p>La COVID-19 a beaucoup perturb\u00e9 le travail de l\u2019OSSNR et a mis l\u2019organisation\nau d\u00e9fi de respecter les \u00e9ch\u00e9anciers minist\u00e9riels. Au cours de la p\u00e9riode de\nr\u00e9f\u00e9rence, une seule demande li\u00e9e \u00e0 la protection des renseignements\npersonnels a \u00e9t\u00e9 touch\u00e9e.<\/p>\n\n\n\n<p>Depuis, l\u2019OSSNR a mis en \u0153uvre des outils suppl\u00e9mentaires pour permettre de\nplus en plus aux employ\u00e9s de bien fonctionner tout en travaillant \u00e0 domicile\npendant la pand\u00e9mie. Compte tenu du caract\u00e8re hautement d\u00e9licat des\nrenseignements que d\u00e9tient l\u2019OSSNR et de la tr\u00e8s faible quantit\u00e9 de dossiers\nnum\u00e9ris\u00e9s, r\u00e8gle g\u00e9n\u00e9rale, il n\u2019est pas possible d\u2019effectuer les recherches \u00e0\ndistance.<\/p>\n\n\n\n<p>Un r\u00e9sum\u00e9 statistique montrant le traitement des demandes figure \u00e0 l\u2019annexe B.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4-highlights-of-the-fiscal-quarter-and-fiscal-year-to-date-results\">Formation et sensibilisation<\/h2>\n\n\n\n<p>Au cours de la p\u00e9riode de r\u00e9f\u00e9rence, l\u2019OSSNR n\u2019a exist\u00e9 que pendant huit mois.\nL\u2019OSSNR offre une formation individuelle aux employ\u00e9s et \u00e0 la direction afin\nd\u2019aider au traitement des demandes re\u00e7ues en mati\u00e8re de protection des\nrenseignements personnels. Toutefois, la direction s\u2019est engag\u00e9e \u00e0 mettre en\n\u0153uvre un programme de formation et de sensibilisation sur la protection des\nrenseignements personnels pour ses gestionnaires et ses employ\u00e9s afin de\ns\u2019assurer que l\u2019OSSNR se conforme aux exigences de la LPRP.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-access-to-information--policies-guidelines-procedures-and-initiatives-\">Acc\u00e8s \u00e0 l'information (politiques, lignes directrices, proc\u00e9dures et projets)<\/h2>\n\n\n\n<p>L\u2019OSSNR a \u00e9t\u00e9 int\u00e9gr\u00e9 avec succ\u00e8s au service automatis\u00e9 de demande en ligne\ndu Secr\u00e9tariat du Conseil du Tr\u00e9sor (SCT) en octobre 2019. L\u2019OSSNR a mis en\n\u0153uvre des proc\u00e9dures de base et partag\u00e9 l\u2019information n\u00e9cessaire pour\ns\u2019assurer que ses employ\u00e9s et ses gestionnaires se conforment aux politiques et\naux lignes directrices du SCT sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"7-complaints-and-investigations\">Plaintes et enqu\u00eates<\/h2>\n\n\n\n<p>L\u2019OSSNR a re\u00e7u une nouvelle plainte durant la p\u00e9riode vis\u00e9e. Le CPVP a conclu\nque la plainte \u00e9tait fond\u00e9e, et le dossier a \u00e9t\u00e9 ferm\u00e9 le 21 janvier 2020.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"8-monitoring-processing-time\">Surveillance du d\u00e9lai de traitement<\/h2>\n\n\n\n<p>Le d\u00e9lai de traitement des demandes fait l\u2019objet d\u2019un suivi gr\u00e2ce au tableau de\nbord du logiciel Access Pro. Lorsqu\u2019il existe un risque de ne pas pouvoir\nrespecter les d\u00e9lais pr\u00e9vus par la loi, le coordonnateur de l\u2019AIPRP avise le\ndirecteur ex\u00e9cutif et lui sugg\u00e8re un plan d\u2019action.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"9-material-privacy-breaches\">Atteintes substantielles \u00e0 la vie priv\u00e9e<\/h2>\n\n\n\n<p>Aucune atteinte importante \u00e0 la vie priv\u00e9e n\u2019a \u00e9t\u00e9 signal\u00e9e au CPVP et au SCT\n(Division des politiques de l\u2019information et de la protection des renseignements\npersonnels) pendant la p\u00e9riode vis\u00e9e par le rapport.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"10-privacy-impact-assessments\">\u00c9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e<\/h2>\n\n\n\n<p>Le projet de loi C-59 a re\u00e7u la sanction royale le 21 juin 2019 et la&nbsp;<em>Loi sur l\u2019Office de surveillance des activit\u00e9s en mati\u00e8re de s\u00e9curit\u00e9 nationale et de renseignement&nbsp;<\/em>est entr\u00e9e en vigueur le 12 juillet 2019. L\u2019une des exigences de la\nLoi \u00e9tait d\u2019effectuer une \u00e9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e (\u00c9FVP) par\nrapport aux activit\u00e9s de l\u2019OSSNR.<\/p>\n\n\n\n<p>Un expert externe a men\u00e9 l\u2019\u00c9FVP au cours de l\u2019ann\u00e9e. L\u2019\u00c9FVP visait \u00e0 fournir\ndes recommandations et des directives pour veiller \u00e0 ce que les programmes et\nles activit\u00e9s de l\u2019OSSNR se conforment \u00e0 l\u2019esprit et aux exigences de la LPRP,\naux principes g\u00e9n\u00e9ralement reconnus en mati\u00e8re de protection des\nrenseignements personnels ainsi qu\u2019aux normes de protection des\nrenseignements personnels reconnues \u00e0 l\u2019\u00e9chelle internationale.<\/p>\n\n\n\n<p>Les r\u00e9sultats et les recommandations ont \u00e9t\u00e9 communiqu\u00e9s \u00e0 l\u2019\u00e9quipe de la\nhaute direction de l\u2019OSSNR juste avant la pand\u00e9mie de Covid-19. La direction de\nl\u2019OSSNR est en train d\u2019\u00e9laborer un plan d\u2019action en gestion pour donner suite\naux recommandations de l\u2019\u00e9valuation.<\/p>\n\n\n\n<h2
