La LCISC permet aux institutions f\u00e9d\u00e9rales d\u2019\u00e9changer de l\u2019information afin de garantir la s\u00e9curit\u00e9 nationale tout en prot\u00e9geant les donn\u00e9es personnelles confidentielles comme les renseignements sur l\u2019immigration et les d\u00e9placements. En vertu de l\u2019article 39 de la Loi sur l\u2019OSSNR, l\u2019Office de surveillance doit examiner ces communications chaque ann\u00e9e et rendre publiquement compte de leur conformit\u00e9 aux normes juridiques, de leur caract\u00e8re juste et adapt\u00e9, et du fait qu\u2019elles respectent les renseignements personnels.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Importance de la question<\/h3>\n\n\n\n<p>Les \u00e9changes d\u2019information au titre de la LCISC peuvent avoir des r\u00e9percussions importantes sur la vie priv\u00e9e des personnes et sur les droits garantis par la Charte.<\/p>\n\n\n\n<p>L\u2019examen de l\u2019OSSNR met en lumi\u00e8re les am\u00e9liorations apport\u00e9es \u00e0 la fa\u00e7on dont les institutions appliquent la Loi et pr\u00e9sente les aspects qui n\u00e9cessitent des pr\u00e9cisions et des mesures de protection suppl\u00e9mentaires pour faire en sorte que les communications demeurent l\u00e9gales, proportionnelles et respectueuses de la confidentialit\u00e9 des renseignements personnels.<\/p>\n\n\n\n<p>Cette vigilance permet de prot\u00e9ger les droits des Canadiens tout en permettant la r\u00e9ussite des op\u00e9rations de s\u00e9curit\u00e9 nationale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Objet de l\u2019examen<\/h3>\n\n\n\n<p>L\u2019examen de l\u2019OSSNR a permis d\u2019\u00e9tablir si les institutions f\u00e9d\u00e9rales :<\/p>\n\n\n\n<ul>\n<li>s\u2019\u00e9taient conform\u00e9es aux exigences de la LCISC en mati\u00e8re de communication d\u2019information et de tenue de dossiers;<\/li>\n\n\n\n<li>avaient respect\u00e9 les crit\u00e8res d\u00e9finis par la Loi quant \u00e0 la contribution et \u00e0 la proportionnalit\u00e9;<\/li>\n\n\n\n<li>avaient g\u00e9r\u00e9 les renseignements personnels conform\u00e9ment aux obligations en mati\u00e8re de protection des renseignements personnels et aux prescriptions de la Charte.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019examen a port\u00e9 sur les communications faites en 2024 par l\u2019Agence des services frontaliers du Canada (ASFC), le Centre de la s\u00e9curit\u00e9 des t\u00e9l\u00e9communications (CST), le Service canadien du renseignement de s\u00e9curit\u00e9 (SCRS), Affaires mondiales Canada (AMC), Immigration, R\u00e9fugi\u00e9s et Citoyennet\u00e9 Canada (IRCC) et la Gendarmerie royale du Canada (GRC). Or, en raison d\u2019une augmentation importante des communications d\u2019IRCC au SCRS, l\u2019Office de surveillance a concentr\u00e9 son examen principalement sur les \u00e9changes d\u2019information entre ces deux organismes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l\u2019OSSNR a constat\u00e9<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Contexte et principales tendances<\/h4>\n\n\n\n<ul>\n<li class=\" translation-block\"><Strong>Augmentation significative du nombre des communications :<\/strong> En 2024, les institutions du gouvernement du Canada ont effectu\u00e9 900 communications au titre de la LCISC. Pendant ce temps, les communications d\u2019IRCC au SCRS ont augment\u00e9 de pr\u00e8s de 300 %, passant de 194 en 2023 \u00e0 770 en 2024. Cette augmentation t\u00e9moigne d\u2019une nouvelle tendance ax\u00e9e sur le recours \u00e0 la LCISC comme principal m\u00e9canisme d\u2019\u00e9change de renseignements ayant trait \u00e0 l\u2019immigration.<\/li>\n\n\n\n<li class=\" translation-block\"><strong>Changements dans les pratiques de communication :<\/strong> L\u2019OSSNR a constat\u00e9 qu\u2019au printemps 2024, IRCC et le SCRS avaient mis en \u0153uvre un processus de demande et de communication d\u2019information comportant plusieurs niveaux. Par ailleurs, ce processus \u00e9tablissait une distinction entre les communications \u00e9l\u00e9mentaires et les communications avanc\u00e9es, et comportait des mod\u00e8les normalis\u00e9s. L\u2019OSSNR a constat\u00e9 que cette initiative avait r\u00e9duit le nombre des communications inutiles de renseignements personnels et de tiers, et qu\u2019elle avait permis de renforcer la conformit\u00e9 aux exigences de la LCISC sur le plan de la protection des renseignements personnels.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Constatations<\/h4>\n\n\n\n<ul>\n<li><strong>Conformit\u00e9 en mati\u00e8re de tenue de dossiers :<\/strong> L\u2019OSSNR a constat\u00e9 que globalement, les institutions avaient respect\u00e9 les obligations impos\u00e9es par la LCISC en mati\u00e8re de tenue de dossiers pour ce qui touche les communications effectu\u00e9es en 2024.<\/li>\n\n\n\n<li><strong>Justification lacunaire des demandes :<\/strong> Dans quelques cas, l\u2019OSSNR a constat\u00e9 que l\u2019information que le SCRS produisait dans ses demandes pouvait s\u2019av\u00e9rer lacunaire, ce qui a r\u00e9duit la capacit\u00e9 d\u2019IRCC, en tant qu\u2019institution appel\u00e9e \u00e0 communiquer l\u2019information, d\u2019\u00e9valuer pleinement si les communications demand\u00e9es r\u00e9pondaient aux crit\u00e8res de contribution et de proportionnalit\u00e9 de la LCISC.<\/li>\n\n\n\n<li><strong>Communications au sujet de personnes mineures :<\/strong> L\u2019OSSNR a constat\u00e9 qu\u2019IRCC ne disposait d\u2019aucune politique officielle r\u00e9gissant les communications concernant des personnes mineures, ce qui a donn\u00e9 lieu \u00e0 un traitement incoh\u00e9rent de leurs renseignements personnels.<\/li>\n\n\n\n<li><strong>Conservation d\u2019information non n\u00e9cessaire :<\/strong> L\u2019OSSNR a conclu que, dans un cas, le SCRS avait conserv\u00e9 des renseignements personnels qui n\u2019\u00e9taient pas n\u00e9cessaires \u00e0 l\u2019exercice de son mandat en mati\u00e8re de s\u00e9curit\u00e9 nationale, ce qui \u00e9tait contraire aux dispositions de la LCISC.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l\u2019OSSNR recommande<\/h3>\n\n\n\n<p>L\u2019OSSNR a formul\u00e9 un certain nombre de recommandations visant \u00e0 renforcer la conformit\u00e9 aux dispositions de la LCISC :<\/p>\n\n\n\n<ul>\n<li>veiller \u00e0 ce que les institutions qui demandent de l\u2019information fournissent suffisamment d\u2019\u00e9l\u00e9ments pour permettre aux institutions qui communiquent d\u2019\u00e9valuer la n\u00e9cessit\u00e9 et la proportionnalit\u00e9 de la demande;<\/li>\n\n\n\n<li>\u00e9laborer une politique permettant d\u2019encadrer les communications concernant les personnes mineures et reconna\u00eetre que celles ci ont des int\u00e9r\u00eats distincts en mati\u00e8re de protection des renseignements personnels;<\/li>\n\n\n\n<li>confiner les \u00e9changes et la conservation des renseignements personnels \u00e0 ce qui est n\u00e9cessaire \u00e0 la protection de la s\u00e9curit\u00e9 nationale.<\/li>\n<\/ul>\n<\/div><\/div>\n<\/div><\/div><\/section>","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":2200,"parent":8677,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"template-nsira-subpages.php","meta":{"inline_featured_image":false},"categories":[19,24,28],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.9 -
