Cette collaboration est essentielle \u00e0 la s\u00e9curit\u00e9 nationale dans la mesure o\u00f9 ces deux principaux organismes du renseignement canadien sont responsables respectivement du renseignement \u00e9lectromagn\u00e9tique et du renseignement humain.<\/p>\n\n\n\n<p>Cet examen est le premier \u00e0 porter sur la collaboration entre le CST et le SCRS. En effet, les organismes d\u2019examen qui ont pr\u00e9c\u00e9d\u00e9 l\u2019OSSNR n\u2019avaient pas le pouvoir d\u2019\u00e9valuer les activit\u00e9s se d\u00e9roulant dans plus d\u2019un minist\u00e8re ou organisme. Dans le cas pr\u00e9sent, l\u2019OSSNR a examin\u00e9 un \u00e9ventail d\u2019activit\u00e9s, \u00e0 savoir les activit\u00e9s op\u00e9rationnelles, les \u00e9changes de renseignement et les mesures de conformit\u00e9 aux dispositions des lois habilitantes s\u2019appliquant \u00e0 l\u2019un et l\u2019autre des organismes.<\/p>\n\n\n\n<p>L\u2019examen a \u00e9galement permis \u00e0 l\u2019OSSNR de r\u00e9pondre \u00e0 une exigence pr\u00e9vue au paragraphe 8(2) de la Loi sur l\u2019Office de surveillance des activit\u00e9s en mati\u00e8re de s\u00e9curit\u00e9 nationale et de renseignement, celle d\u2019examiner annuellement au moins un aspect des mesures de r\u00e9duction de la menace (MRM) prises par le SCRS.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Importance de la question<\/h3>\n\n\n\n<p>La collaboration entre le CST et le SCRS joue un r\u00f4le important lorsqu\u2019il s\u2019agit d\u2019assurer la s\u00e9curit\u00e9 du Canada. Or, des modalit\u00e9s de collaboration qui ne sont pas clairement structur\u00e9es ni bien r\u00e9gies peuvent poser des risques juridiques et r\u00e9duire l\u2019efficacit\u00e9 des activit\u00e9s de renseignement.<\/p>\n\n\n\n<p>L\u2019examen de l\u2019OSSNR fait \u00e9tat de la n\u00e9cessit\u00e9 de clarifier les r\u00e8gles, de planifier avec plus de rigueur et de mettre davantage l\u2019accent sur la coh\u00e9rence des communications, de sorte que la collaboration demeure l\u00e9gale, responsable et efficace. Ce type d\u2019encadrement contribue \u00e0 prot\u00e9ger les droits des Canadiens tout en favorisant de solides r\u00e9sultats en mati\u00e8re de s\u00e9curit\u00e9 nationale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Objet de l\u2019examen<\/h3>\n\n\n\n<p>L\u2019examen de l\u2019OSSNR a \u00e9t\u00e9 l\u2019occasion de v\u00e9rifier si le CST et le SCRS :<\/p>\n\n\n\n<ul>\n<li>avaient collabor\u00e9 de fa\u00e7on \u00e0 respecter les diff\u00e9rences entre leurs mandats juridiques;<\/li>\n\n\n\n<li>disposaient de politiques, de proc\u00e9dures et de modes de planification clairs permettant de g\u00e9rer les risques que la collaboration pourrait poser sur le plan de la l\u00e9galit\u00e9 et de la conformit\u00e9;<\/li>\n\n\n\n<li>avaient \u00e9chang\u00e9 de l\u2019information en conformit\u00e9 aux lois applicables et dans le respect des contraintes juridiques, tout en s\u2019appuyant sur des modalit\u00e9s de gouvernance et de responsabilisation claires;<\/li>\n\n\n\n<li>avaient respect\u00e9 les exigences l\u00e9gales s\u2019appliquant aux consultations et aux \u00e9changes de renseignements lorsque le SCRS a pris des mesures de r\u00e9duction de la menace (MRM) touchant le CST ou n\u00e9cessitant son intervention.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019examen a port\u00e9 sur un \u00e9chantillon d\u2019activit\u00e9s de collaboration op\u00e9rationnelle et d\u2019\u00e9change d\u2019information entre le CST et le SCRS, notamment sur le soutien que le CST a fourni au SCRS, sur les op\u00e9rations conjointes et sur la coordination requise dans le contexte de mesures de r\u00e9duction de la menace.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l\u2019OSSNR a constat\u00e9<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Contexte<\/h4>\n\n\n\n<p>Le SCRS est en droit de recueillir et d\u2019\u00e9changer de l\u2019information sur les Canadiens dans le cadre de son mandat en mati\u00e8re de renseignement et de r\u00e9duction de la menace. Or, il est interdit au CST de diriger ses activit\u00e9s de renseignement \u00e9tranger vers des Canadiens ou vers toute personne se trouvant au Canada. Lorsque les deux organismes collaborent, cette distinction pose certains risques et exige une planification minutieuse ainsi que des r\u00e8gles claires.<\/p>\n\n\n\n<p>En m\u00eame temps, le CST et le SCRS disposent de capacit\u00e9s compl\u00e9mentaires. Ainsi, lorsqu\u2019elle est rigoureusement planifi\u00e9e et ad\u00e9quatement gouvern\u00e9e, la collaboration permet d\u2019optimiser les r\u00e9sultats auxquels le Canada peut s\u2019attendre \u00e0 l\u2019\u00e9gard du renseignement.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Constatations<\/h4>\n\n\n\n<ul>\n<li><strong>Collaboration op\u00e9rationnelle :<\/strong> L\u2019OSSNR a constat\u00e9 que la collaboration ne comptait pas toujours sur des mesures pr\u00e9alables comme la planification ou l\u2019\u00e9tablissement de mesures d\u2019att\u00e9nuation des risques. Dans certains cas, le CST n\u2019a pas ad\u00e9quatement tenu compte du risque accru de diriger ses activit\u00e9s vers des Canadiens lorsqu\u2019il a collabor\u00e9 avec le SCRS. L\u2019OSSNR a relev\u00e9 deux cas de non conformit\u00e9 \u00e0 la loi.<\/li>\n\n\n\n<li><strong>\u00c9changes d\u2019information :<\/strong> L\u2019OSSNR a constat\u00e9 que certaines pratiques d\u2019\u00e9change d\u2019information ne reposaient pas sur une gouvernance claire ni sur des proc\u00e9dures coh\u00e9rentes. Ces lacunes ont accru le risque que l\u2019information canadienne puisse \u00eatre utilis\u00e9e d\u2019une mani\u00e8re qui serait contraire aux stipulations du mandat du CST. L\u2019OSSNR a relev\u00e9 un cas de non conformit\u00e9 li\u00e9 \u00e0 la communication d\u2019information.<\/li>\n\n\n\n<li><strong>Mesures de r\u00e9duction de la menace (MRM) :<\/strong> L\u2019OSSNR a constat\u00e9 que le SCRS avait consult\u00e9 le CST lors de la planification des mesures de r\u00e9duction de la menace, mais il a \u00e9galement remarqu\u00e9 qu\u2019en cours de processus, les consultations et les \u00e9changes d\u2019information n\u2019\u00e9taient pas toujours suffisamment d\u00e9taill\u00e9s ou opportuns. L\u2019OSSNR a \u00e9galement constat\u00e9 que les \u00e9changes d\u2019information pourraient \u00eatre am\u00e9lior\u00e9s lorsque des probl\u00e8mes de conformit\u00e9 surviennent dans le cadre d\u2019activit\u00e9s impliquant les deux organisations.<\/li>\n\n\n\n<li><strong>Coop\u00e9ration entre les organismes :<\/strong> L\u2019OSSNR a constat\u00e9 que les communications et la coop\u00e9ration entre le CST et le SCRS pouvaient s\u2019av\u00e9rer incoh\u00e9rentes et que dans certains cas, elles limitaient la capacit\u00e9 d\u2019utiliser pleinement la collaboration int\u00e9rieure pour faire progresser les priorit\u00e9s canadiennes en mati\u00e8re de renseignement.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que l\u2019OSSNR recommande<\/h3>\n\n\n\n<p>L\u2019OSSNR a formul\u00e9 plusieurs recommandations visant \u00e0 renforcer la collaboration et la conformit\u00e9 :<\/p>\n\n\n\n<ul>\n<li>am\u00e9liorer la planification conjointe, les politiques, les proc\u00e9dures et la formation;<\/li>\n\n\n\n<li>am\u00e9liorer la gouvernance et  la coh\u00e9rence des pratiques d\u2019\u00e9change d\u2019information;<\/li>\n\n\n\n<li>am\u00e9liorer les modalit\u00e9s de consultation et d\u2019\u00e9change d\u2019information concernant les mesures de r\u00e9duction de la menace;<\/li>\n\n\n\n<li>accro\u00eetre l\u2019efficacit\u00e9 des communications et de la coop\u00e9ration entre les services.<\/li>\n<\/ul>\n<\/div><\/div>\n<\/div><\/div><\/section>","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":2200,"parent":9229,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"template-nsira-subpages.php","meta":{"inline_featured_image":false},"categories":[19,24],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.9 -
