C\u2019\u00e9tait la premi\u00e8re fois que l\u2019OSSNR \u00e9tait saisi de renvois par la CCDP en vertu de l\u2019article 45.<\/p>\n\n\n\n<p>Les plaignants, des ressortissants iraniens, all\u00e8guent que le gouvernement du Canada a exerc\u00e9 \u00e0 leur encontre une discrimination fond\u00e9e sur l\u2019origine nationale ou ethnique ou sur la race en raison des retards dans le traitement de leur demande de visa de r\u00e9sidence temporaire ou permanente, ou de citoyennet\u00e9 canadienne.&nbsp;<\/p>\n\n\n\n<p class=\" translation-block\">En vertu de l\u2019article 46 de la \u00a0<em>Loi canadienne sur les droits de la personne\u00a0<\/em>, l\u2019OSSNR est tenu de mener une enqu\u00eate et de remettre un rapport \u00e0 la CCDP. Cet article pr\u00e9voit \u00e9galement qu\u2019en se fondant sur le rapport de l\u2019OSSNR, la CCDP peut rejeter la plainte ou en poursuivre le traitement.<\/p>\n\n\n\n<p>Le r\u00f4le de l\u2019OSSNR dans les renvois au titre de l\u2019article 45 se limite \u00e0 examiner les \u00e9l\u00e9ments d\u2019une affaire qui sont fond\u00e9s sur des consid\u00e9rations ayant trait \u00e0 la s\u00e9curit\u00e9 du Canada, et \u00e0 rendre compte des conclusions de son enqu\u00eate sur de l\u2019information classifi\u00e9e \u00e0 la CCDP de\n\nmani\u00e8re non classifi\u00e9e. L\u2019OSSNR n\u2019est pas habilit\u00e9 \u00e0 exercer le pouvoir discr\u00e9tionnaire conf\u00e9r\u00e9 par la loi \u00e0 la CCDP de renvoyer l\u2019affaire au Tribunal canadien des droits de la personne.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Enqu\u00eate&nbsp;<\/h4>\n\n\n\n<p>Au cours de son enqu\u00eate, l\u2019OSSNR a examin\u00e9 les \u00e9l\u00e9ments de preuve fournis par les t\u00e9moins et les observations de leurs avocats lors d\u2019une entrevue d\u2019enqu\u00eate, ainsi que la documentation et les observations soumises par les parties gouvernementales, y compris les documents classifi\u00e9s communiqu\u00e9s \u00e0 l\u2019OSSNR par le SCRS, Immigration, R\u00e9fugi\u00e9s et Citoyennet\u00e9 Canada (IRCC), l\u2019Agence des services frontaliers du Canada (ASFC) et S\u00e9curit\u00e9 publique Canada.&nbsp;<\/p>\n\n\n\n<p>Il est important de noter que l\u2019OSSNR a entendu les parties gouvernementales au sujet d\u2019un indicateur obligatoire en particulier \u00e9labor\u00e9 par l\u2019ASFC et utilis\u00e9 par les agents d\u2019IRCC pour prendre des d\u00e9cisions sur les renvois aux fins de contr\u00f4le de s\u00e9curit\u00e9 des demandes d\u2019immigration iraniennes. Avant les r\u00e9formes effectu\u00e9es en ao\u00fbt 2018, un indicateur \u00e9tait enti\u00e8rement fond\u00e9 sur la nationalit\u00e9 iranienne, et n\u2019\u00e9tait associ\u00e9 qu\u2019\u00e0 l\u2019\u00e2ge et au sexe du demandeur. Lorsqu\u2019un demandeur r\u00e9pondait aux crit\u00e8res, les agents d\u2019IRCC transmettaient automatiquement le dossier \u00e0 l\u2019ASFC et au SCRS aux fins de contr\u00f4le de s\u00e9curit\u00e9. Les \u00e9l\u00e9ments de preuve montrent que le gouvernement a abandonn\u00e9 les indicateurs obligatoires en 2018 pour des raisons d\u2019efficacit\u00e9 et parce qu\u2019ils contribuaient \u00e0 des retards.&nbsp;<\/p>\n\n\n\n<p>L\u2019OSSNR a \u00e9galement constat\u00e9 qu\u2019IRCC ne consignait pas d\u2019information sur l\u2019indicateur en particulier sur lequel le renvoi se fondait. Cela a nui \u00e0 la capacit\u00e9 de l\u2019OSSNR \u00e0 enqu\u00eater sur les autres indicateurs susceptibles d\u2019avoir eu une incidence sur le traitement de la demande d\u2019immigration d\u2019un plaignant. Cela dit, l\u2019OSSNR a reconnu qu\u2019un syst\u00e8me de codes de suivi des indicateurs faisait l\u2019objet d\u2019un projet pilote au moment de l\u2019entrevue d\u2019enqu\u00eate. Cette solution technique permettrait d\u2019assurer le suivi des d\u00e9cisions des agents d\u2019IRCC de renvoyer des demandes d\u2019immigration aux fins de contr\u00f4le de s\u00e9curit\u00e9 au moyen d\u2019un syst\u00e8me de codes indiquant le motif du renvoi.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Conclusion&nbsp;<\/h4>\n\n\n\n<p>L\u2019OSSNR a constat\u00e9 les faits suivants :&nbsp;<\/p>\n\n\n\n<ul>\n<li class=\" translation-block\">l\u2019indicateur obligatoire d\u2019\u00e2ge et de sexe utilis\u00e9 par IRCC dans le traitement des demandes d\u2019immigration jusqu\u2019en mai 2018 reposait exclusivement sur la nationalit\u00e9, l\u2019\u00e2ge et le sexe, qui figurent parmi les motifs de distinction illicite aux termes de l\u2019article 5 de la <em>Loi canadienne sur les droits de la personne<\/em>;<\/li>\n\n\n\n<li>l\u2019indicateur obligatoire d\u2019\u00e2ge et de sexe a d\u00e9savantag\u00e9 (notamment en entra\u00eenant des retards) les Iraniens soumis \u00e0 un contr\u00f4le de s\u00e9curit\u00e9 et ceux dont les dossiers \u00e9taient li\u00e9s \u00e0 ces demandeurs;&nbsp;<\/li>\n\n\n\n<li>\u00e0 l\u2019\u00e9poque des faits en cause dans cette affaire, l\u2019application de cet indicateur obligatoire n\u2019\u00e9tait pas justifiable pour des raisons de s\u00e9curit\u00e9 nationale;&nbsp;<\/li>\n\n\n\n<li class=\" translation-block\">la proc\u00e9dure de contr\u00f4le de s\u00e9curit\u00e9 applicable aux demandes de citoyennet\u00e9 dans cette affaire n\u2019a pas entra\u00een\u00e9 de d\u00e9savantage fond\u00e9 sur les motifs \u00e9num\u00e9r\u00e9s dans la <em>Loi canadienne sur les droits de la personne<\/em>, \u00e9tant donn\u00e9 que les demandes de citoyennet\u00e9 re\u00e7ues par IRCC sont envoy\u00e9es au SCRS aux fins de contr\u00f4le de s\u00e9curit\u00e9, quel que soit le pays de naissance du demandeur.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019OSSNR a soumis son rapport \u00e0 la CCDP afin qu\u2019elle puisse d\u00e9terminer s\u2019il y a un fondement raisonnable dans la preuve pour un renvoi au Tribunal canadien des droits de la personne ou s\u2019il convient de rejeter les plaintes.&nbsp;<\/p>\n<\/div><\/div>\n<\/div><\/div><\/section>","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":7790,"menu_order":2,"comment_status":"closed","ping_status":"closed","template":"template-nsira-subpages.php","meta":{"inline_featured_image":false},"categories":[],"tags":[145,47,84,77,89,87],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.9 -
