Has Your Complaint Against the Royal Canadian Mounted Police Been Referred to NSIRA by the Civilian Review and Complaints Commission for the RCMP?<\/h2>\n<\/div><\/div>\n\n\n\n

You have received a notice from the Civilian Review and Complaints Commission for the RCMP (CRCC) informing you that your complaint has been referred to NSIRA.<\/p>\n\n\n\n

What you need to know:<\/h3>\n\n\n\n
    \n
  • You don\u2019t need to hire a lawyer or get legal assistance<\/li>\n\n\n\n
  • If you decide to seek legal advice, you are responsible for paying your legal fees and associated costs<\/li>\n\n\n\n
  • NSIRA is an independent and external review agency<\/li>\n\n\n\n
  • The RCMP is the respondent<\/li>\n<\/ul>\n\n\n\n

    When NSIRA receives the CRCC\u2019s referral of your complaint, NSIRA will:<\/strong><\/p>\n\n\n\n

      \n
    • Acknowledge in writing that NSIRA has received the referral of your complaint by the CRCC<\/li>\n\n\n\n
    • Inform you that NSIRA will investigate your complaint if it is satisfied that the complaint is not trivial, frivolous or vexatious or made in bad faith.<\/li>\n\n\n\n
    • Conduct a preliminary review of the information received from the CRCC and determine if the complaint falls within NSIRA\u2019s mandate to investigate the complaint<\/li>\n<\/ul>\n<\/div><\/div>\n<\/div><\/div><\/section>\n\n\n\n

      What happens next?<\/strong><\/h3>\n\n\n\n
      \n\n\t\n\t
      \n\t\tWhat happens if your complaint does not fall within NSIRA\u2019s mandate to investigate?<\/summary>\n\t\t
      \n\t\t\t

      Should NSIRA determine it is not within its mandate to investigate your complaint, your complaint file will be closed. NSIRA will inform you, by letter, of its decision.<\/p>\n\t\t<\/div>\n\t<\/details>\n\n\t\n\t

      \n\t\tWhat happens if your complaint falls within NSIRA\u2019s mandate to investigate?<\/summary>\n\t\t
      \n\t\t\t

      NSIRA will inform you and the respondent (s) of the next steps in the complaint process.<\/p>\n

      NSIRA may contact you and seek your availability for an investigative interview to clarify the nature and scope of your allegations. It may hold a case management conference to determine procedural matters.<\/p> \n

      NSIRA may also determine that an oral or written hearing is necessary in order to fully investigate and consider some or all of the issues of your complaint.<\/p>\n\t\t<\/div>\n\t<\/details>\n\n \n\t

      \n\t\tHere\u2019s what happens next following NSIRA\u2019s consideration of the evidence:<\/summary>\n\t\t
      \n\t\t\t

      Once NSIRA has examined the documentary evidence, conducted investigative interviews and\/or held a hearing, the NSIRA Member assigned to investigate your complaint will prepare a final report which will include its findings and\/or recommendations based on the evidence and written submissions received from the parties. An unclassified copy of the final report will be sent to you.<\/p>\n\t\t<\/div>\n\t<\/details>\n\n \n\t
