The complainant alleged that the RCMP carried out an unjustified and arbitrary arrest of&nbsp;their minor son, conducted a zealous and abusive search of the&nbsp;family&nbsp;home, and publicized&nbsp;the arrest.&nbsp;<\/p>\n\n\n\n<p>In addition, the complainant alleged that the RCMP disclosed information to U.S. authorities,&nbsp;stated&nbsp;that the complainant\u2019s son\u2019s arrest form would be forgotten and destroyed, and violated&nbsp;the son\u2019s safety and that of his family, their constitutional&nbsp;rights&nbsp;and their whistleblower rights.&nbsp;<\/p>\n\n\n\n<p>The RCMP concluded, in a report sent to the complainant&nbsp;pursuant to&nbsp;section 45.64 of the&nbsp;<em>Royal Canadian Mounted Police Act&nbsp;<\/em>(RCMP Act), that the members had acted appropriately and&nbsp;consequently&nbsp;did not support any of the complainant\u2019s allegations.&nbsp;<\/p>\n\n\n\n<p>The complainant referred their complaint to the CRCC for review as they were not satisfied with&nbsp;the RCMP\u2019s findings. The CRCC referred the complaint to NSIRA&nbsp;pursuant to&nbsp;subsection&nbsp;45.53(4.1) of the RCMP Act.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Investigation&nbsp;<\/h4>\n\n\n\n<p>NSIRA&nbsp;determined&nbsp;that it had&nbsp;jurisdiction&nbsp;to review the request for review of the RCMP\u2019s report&nbsp;under section 19 of the NSIRA Act.&nbsp;<\/p>\n\n\n\n<p>NSIRA\u2019s investigation included a review of:&nbsp;<\/p>\n\n\n\n<ul>\n<li>the&nbsp;complaint;&nbsp;<\/li>\n\n\n\n<li>the complainant\u2019s request for review filed with the&nbsp;CRCC;&nbsp;<\/li>\n\n\n\n<li>the RCMP investigation file related to the complaint, including documents provided&nbsp;by the complainant during the investigation; and&nbsp;<\/li>\n\n\n\n<li>the RCMP\u2019s operational file related to the complaint, including&nbsp;numerous&nbsp;audio&nbsp;and video recordings, as well as relevant policies and legislation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Conclusion<\/strong>&nbsp;<\/h4>\n\n\n\n<p>NSIRA found that the RCMP\u2019s conclusions in its report were reasonable.&nbsp;<\/p>\n\n\n\n<p>Notwithstanding the foregoing, NSIRA pointed out to the RCMP the importance of the decisionmaker&nbsp;and signatory of an RCMP report having no prior involvement with the file that is the&nbsp;subject of the complaint, in addition to the importance of complete and contemporaneous&nbsp;notetaking.&nbsp;<\/p>\n<\/div><\/div>\n<\/div><\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":7790,"menu_order":4,"comment_status":"closed","ping_status":"closed","template":"template-nsira-subpages.php","meta":{"inline_featured_image":false},"categories":[],"tags":[147,47,125,85],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.9 -
